Attorney General Masères' Criticisms of Governor Carleton's Report on the Laws of the Province, 1769

Francis Masères was attorney general of Québec from 1766 to 1769.


Document Summary:
Masères disapproves of Carleton's plan to revive French civil law, as:

  • It is inconsistent with the king's former plans for the province.

  • It will make administering justice difficult for English inhabitants of Québec.

  • It will remind the inhabitants of their former rulers (i.e.: France).

  • It will discourage English settlers from coming to the province.

Furthermore, Masères does not believe anyone is distressed at the English laws. He recommends a code of laws that combine English and French civil and criminal laws selectively. Otherwise, he feels English criminal law should continue in parallel with French laws regarding tenures, etc.
